Notice of Privacy Policy.

THIS NOTICE OF PRIVACY PRACTICES (NPP) DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY. THIS NPP IS IN COMPLIANCE WITH THE HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT (HIPAA) ENACTED IN 1996, WHICH ESTABLISHED GUIDELINES FOR PROTECTED HEALTH INFORMATION (PHI).
I. Uses and Disclosures of PHI That May Be Made Without Your Consent:
a. Treatment
We may use and disclose your PHI to provide, coordinate, or manage your healthcare and any related services.
b. Payment
We may use and disclose your PHI to obtain payment for the services we provide to you. We may use and disclose your PHI to prepare and send a bill to you or to the person responsible for payment of your bill.
c. Healthcare Operations
We may use and disclose your PHI for our healthcare operations, including quality improvement activities and administrative functions for Morgan Petro, LLC.
d. Other
Third Parties: We may share your PHI with external entities we contract for specific services on our behalf. Should we disclose your information to these entities, we will establish agreements to ensure the protection of your information. These third-party entities may include, but are not limited to, accreditation agencies, management consultants, quality assurance reviewers, collection agencies, transcription services, and others.
Required by Law: We may utilize or reveal your PHI as mandated by law. Any such utilization or disclosure will adhere to legal requirements and will be confined to the extent necessary as stipulated by law.
II. Uses and Disclosures of PHI Based Upon Your Written Authorization
a. Marketing
Your written authorization is required for us to use and disclose your personal health information for most marketing purposes.
III. Individual Rights
a. Right to Inspect and Copy
You have the right to inspect and obtain a copy of your PHI. All requests must be made in writing and signed by you or your legal representative.
b. Right to Amend
If you believe that your PHI is incorrect, you have the right to request an amendment. All requests must be made in writing and signed by you or your legal representative. Morgan Petro, LLC is not required to make requested amendments, but will give careful consideration to each request.
c. Right to an Accounting of Disclosures
You have the right to request an accounting of certain disclosures of your PHI.
d. Right to Request Restrictions
You possess the right to request that we refrain from using or disclosing specific portions of your personal health information for treatment, payment, or healthcare operations. While we will carefully consider your request, it is important to note that we are obligated to agree to restrict a disclosure to a health plan only for purposes of payment or healthcare operations, and not for treatment. This agreement applies exclusively to healthcare items or services for which full out-of-pocket payment has been made. If a restriction is agreed upon, we commit to not using or disclosing your personal health information contrary to that restriction, except in cases where emergency treatment is required. It is essential to understand that we cannot agree to restrictions on the use or disclosure of personal health information when such actions are legally mandated or necessary for the administration of our business. All requests for restrictions must be submitted in writing and signed by you or your legal representative.
e. Right to Request Confidential Communications
You have the right to request that we communicate with you in a certain way or at a certain location.
IV. Our Responsibilities
a. Privacy Officer
We have a designated Privacy Officer (listed below) to address any questions or concerns you may have about your privacy.
b. Changes to this NPP
We reserve the right to change the terms of this NPP, and the changes will apply to all PHI we maintain.
V. Complaints
a. If you believe your privacy rights have been violated, you may file a complaint with our privacy officer or with the Secretary of the Department of Health and Human Services. All complaints must be submitted in writing and signed by you or your legal representative.
